The Background
boAt, owned by Imagine Marketing Pvt. Ltd., is a market leader in earphones, speakers, and smartwatches. The company filed a trademark infringement case against Boult Audio, claiming that the name “Boult” was confusingly similar to “boAt.”
Both brands operate in the same product category — audio devices — and target similar customers online and offline. boAt argued that Boult’s branding, packaging, and marketing materials could mislead consumers into believing the two were connected.
During the trademark hearing, both companies presented their evidence and arguments. The Delhi High Court, after carefully examining both brands, agreed that there was a likelihood of confusion:
Because of this, the Court held that Boult’s mark could dilute boAt’s distinctiveness and infringe its trademark rights.
The Outcome – Boult Becomes GoBoult
To comply with the Court’s directions and avoid further legal risks, Boult Audio rebranded itself as “GoBoult.” This change allowed the company to continue operations without violating the injunction order. The addition of “Go” created enough distinction while retaining brand familiarity for customers.
